The Government are considering imposing a maximum fine of £500,000 for breaches to the Data Protection Act. This is likely to be introduced in January 2010.

As the Information Commissioner's Office recently reported that the number of incidents of loss and theft of data had risen to "unacceptable" levels in the past year, they plan to implement heavier penalties for inappropriate use of data to reflect the high importance of safeguarding this.
With more than 200 hospitals and 200 companies reporting breaches of the Data Protection Act in the past two years, and with more and more cases reported by the media including the 25million child benefit records lost in 2007; greater emphasis is now being placed on safeguarding data.
Dave Harris, Director at Mass states that "With fines of half a million pound at steak, it is crucial that we continue to work in partnership with our clients to ensure that their data is effectively managed, safeguarded and stored in order to protect their data subjects, and the future sustainability of their business. Failure to comply with the new regulations and criteria will result in significant losses, affecting both financial strength and brand credibility for the business.
